If You Had a Bank of America Credit Card and Your Debts Were Discharged in a Chapter 7 Bankruptcy, You Could Get Money from a Class Action Settlement.

This informational website will explain what the class action is about, and the terms of the Settlement if it is approved by the United States District Court for the Southern District of New York (the “District Court”), whether you qualify to submit a Claim for a cash award, and what to do if you want to (i) submit a Claim, (ii) object to the Settlement, or (iii) not participate in the Settlement and instead “opt out” of the class action. UPDATE: The District Court has given final approval to the Settlement Agreement. To view the order click here. Settlement awards will be calculated after the period to file an appeal has passed. Payments will be distributed after calculations have been approved. Please be patient.


Your legal rights may be affected whether you act or choose to do nothing. Read carefully, as the following information explains decisions you must make and actions you must take now.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:
SUBMIT A CLAIM FORM This is the only way to get a payment. The Claim Form deadline has passed. The Forms must have been completed and postmarked, or submitted online by 11:59 p.m. on or before January 30, 2018.
EXCLUDE YOURSELF You get no payment under the Settlement. This is the only choice that will allow you to sue Defendants on your own about the claims discussed in the Notice. A written request to exclude yourself must have been completed and postmarked on or before January 30, 2018.
OBJECT You can write to the Court about why you do not agree with any aspect of the Settlement. An objection must have been in writing and filed on or before January 30, 2018.
GO TO A HEARING If you submitted a timely objection, you can ask to speak to the Court about the “fairness” of the Settlement, after you submit your objection. A Notice of Intention to Appear must have been in writing, filed, and postmarked on or before January 30, 2018.
DO NOTHING You get no payment. You give up your rights.
